Terms of Service

Acceptance

By creating a Newmarket Edge account, using our website, mobile apps, or any integration (Gmail, Outlook, Stripe, etc.), you agree to these Terms. If you don't agree, don't use the service.

Who can use Newmarket Edge

  • Agent accounts require an active California Department of Real Estate (DRE) salesperson or broker license. We verify your DRE number at signup.
  • Client accounts are created via invite from a licensed agent or sign-up at newmarkethq.com.
  • You must be 18 or older.
  • One account per person. No sharing credentials.

Subscriptions, trials, and billing

  • Agent plans are billed monthly or annually via Stripe.
  • Every new agent gets a 14-day free trial. A valid card is required at signup. The first charge runs on day 15 unless you cancel before then.
  • You may cancel any time from the Stripe billing portal linked in your account settings. Cancellation takes effect at the end of the current billing period; no prorated refunds for partial periods.
  • Setup fees on the agent platform are $0 permanently. Web Design tiers have setup fees and monthly hosting fees, both disclosed at purchase.
  • Past-due accounts (failed card) are degraded to Starter-equivalent feature access until payment resumes. After 30 days past due, accounts may be suspended.

What we provide

Newmarket Edge provides software tools for licensed California real estate agents: an AI assistant trained in the agent's voice, a client- facing mobile app, 3D listing scans, meeting recording + transcription, a transaction workspace, social post drafting, an agent website (Web Design), MLS search via our data partners, and related features.

What we are not. Newmarket Edge is software, not a brokerage. We do not represent buyers or sellers, hold a real estate license, or offer legal, tax, or financial advice. Output from our AI features is informational only and must be reviewed by a licensed professional before acting on it.

Your content and data

  • You retain ownership of everything you put into the platform — your client list, your photos, your voice samples, your messages, your listings, your inspection reports.
  • You grant us a limited, revocable license to process that content solely to provide the service.
  • You're responsible for having the rights / consent to upload data about your clients (e.g. their phone number, voice recording, photos).
  • You agree not to upload content that violates law, infringes IP, contains malware, or impersonates someone.
  • You can export your data at any time via Account Settings → Export.

Connected accounts (Gmail, Outlook, Stripe, etc.)

When you connect Gmail or Outlook, we use the OAuth access granted to read and send email + read/write calendar events on your behalf. See our Privacy Policy — specifically the "Google user data — Limited Use disclosure" section — for the exact terms of how that data is handled. You can disconnect at any time in the dashboard.

Stripe processes payments under their own terms. We never see or store your card number.

Acceptable use

  • No scraping, reverse-engineering, or bulk-extraction of our data.
  • No reselling Newmarket Edge access (only a licensed agent can hold an agent account).
  • No using the platform to spam, harass, mislead consumers, or violate fair-housing law.
  • No circumventing rate limits, plan gates, or security controls.
  • No use of our AI to impersonate someone else without authorization.

Fair-housing + advertising compliance

You are responsible for ensuring all listings, advertising, and communications produced through Newmarket Edge comply with the federal Fair Housing Act, state law, and your MLS rules. Our content tools generate drafts — you are the licensed professional reviewing and publishing them.

Termination

  • You may terminate at any time by cancelling your subscription + deleting your account from Settings.
  • We may suspend or terminate accounts that violate these Terms, are past due, or pose a security risk.
  • Upon termination, we delete personally identifiable account data within 30 days, retaining only what's required by law (tax records, fraud investigations).

Warranties + liability

The service is provided "as is" without warranty of any kind. To the maximum extent permitted by law, our total liability for any claim related to the service is limited to the amount you paid us in the three months prior to the claim. We are not liable for indirect, consequential, or incidental damages.

Changes

We'll post material changes here and notify connected agents by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

Governing law

These Terms are governed by California law. Disputes are resolved in the state or federal courts located in Los Angeles County, California.
